Going after the wrong target
By davidh

Although it's a shame this happened, she should have sued the person who posted the information, not the site the information was posted. After filing suit against a John Doe or John Does, she could have subpoenaed matchmaker.com to turn over all the information they had which identified the original poster.

The extent of matchmaker.com's liability should be that, when presented with proof that Chase was who she said she was, they took down the profile. The story at bayarea.com says that this happened, so based on what I've heard it sounds like the court made the correct decision.

It also sounds like Chase made a false statement when she said "It's obvious that Matchmaker participated in the creation of the profile [...]". No, what's obvious is that some user of the site participated in the creation of the profile, and that matchmaker.com only posted what that user had written.
