Ive gone on record as hoping for Gary Mitchell. Its certainly the most logical choice, and much more interesting than Khan.
I have a hard time believing Orci outright lied, no comment on any villain mentioned would be the way to go, but outright lying is difficult.
But, I have a hard time believing it isn't Mitchell because -
This point in the timeline makes a lot more sense for Mitchell than for Khan.
We've seen Cumberbatch wearing a star fleet uniform. Certainly, Khan did in space seed, but it would seem odd to do it just for that reason in the movie.
Cumberbatch has zero physical resemblance to Khan in either incarnation. Sure, an actor can adopt an accent, but still...
I dont think it will be gary mitchel due to the fact that the stoty was done in the star trek ongoing comics collection. I think those stories are being played fairly close to the vest with the help of the abrams team. I think it will either be kahn or perhaps some other villan we havent thought to think of yet.

On a semi-related note, I think the term "spoiler" is overused quite frankly. Revealing who the villain in the movie is, is not spoiling the movie for anyone. It's a major plot point that will be known in the poster, trailers, official plot synopsis, etc. anyway. Now, the death of a character or a major plot revelation IS a spoiler and should be attached with a spoiler warning. Just sayin' :)

OK, I read the article. It makes no mention of the current comic book that is supposed to be "canon" to the new continuity. The comic ran a story with Gary Mitchell, so that would mean that Gary MItchell as a character was already used in the story line. Also, I heard Bob Orci answer "no" on a call-in radio show when asked if several TOS characters, including Gary MItchell, were in the new movie. So, unless Orci directly lied (which would not surprising), Gary Mitchell cannot be in the new movie.
Cumby is probably Khan or a new character.
