At the recent Vulkon convention in Cleveland, OH on April 27th, a Paramount attorney arrived with a Cleveland police detail at approximately 1:00 o'clock P.M. with search warrants in-hand. Looking for unlicensed merchandise, the group confiscated STAR TREK products being sold in the vendor's room that were not under license by Viacom (thus not paying a fee to Viacom to sell the product). These included photos and props being sold by vendors in the room.
Occurring in the middle of the afternoon, this action disrupted legitimate business occuring at the licensed event as fans were asked to leave the vicinity of tables being searched. The items confiscated included autographed photos that the guest actors at the event were giving away along with their autograph. In many cases these photos were supplied to the actors by Paramount at some point in the past, and they were being given away as part of the autograph -- the actual product the actors were selling.
This action is not surprising for those familiar with Viacom Consumer Products, the licensing arm of Paramount, that has long sought to vigorously protect the STAR TREK intellectual property rights. VCP has begun licensing convention promoters as a means of getting unlicensed merchandise -- which Viacom claims is of inferior quality -- off the marketplace.
The department's senior vice president, Terri Helton, promised that fans would notice few changes in their favorite STAR TREK events in an interview in the latest Star Trek: Communicator, but this incident would seem to contradict the spirit of those remarks. Big promoters like Vulkon now pay VCP a licensing fee to do business, an amount that Helton says is custom-tailored to each group sponsoring an event and is "no real financial burden" for non-profit groups.
There were rumors following the actions in Cleveland that Paramount had been seizing fan property that was not licensed, but Vulkon organizer Joe Motes says only items for sale were seized. Motes also warns fans to expect similar occurrences at many events in the future.
While the issue of potentially unlicensed photographs remains unclear, it is apparent that Viacom is cracking down on the sale of any items not licensed, even if it means disturbing law-abiding fans at a licensed event.
